6. Description Abstract Since the 1970s, the Supreme Court has handed down many decisions regarding the constitutionality of Affirmative Action programs. The Court’s decisions have evolved with changes in society and changes in the makeup of the Court. This chapter will examine the Court’s decisions on Affirmative Action and look at where we stand on this divisive constitutional issue today.
